What these terms cover, and who they bind
These terms govern the rental of an AMD EPYC server deployed in Tokyo, Japan, and the related site functions: configuration, payment, the console, tickets, and invoices. The service is for an organization that can bear civil liability, or for an individual who is at least 18. If you order for an organization, you confirm that you can bind it.
If a competent authority holds one clause invalid, the rest remain in force. This English page is the text for the English site. Other language sites use the text published on those pages. One language does not automatically govern another.
What is provided
We rent you one physical server, for your account alone, at the specs shown on the order page when you submit. It is not an oversold cloud instance, and it is not a virtual machine shared with other customers. What you can order is:
- Two models: AMD EPYC 7543P with 128GB DDR4-3200 ECC RDIMM at $465 a month, or the same CPU with 256GB at $592 a month. Memory cannot be added after the order.
- 2 × 1TB NVMe by default, no hardware RAID, disks attached directly, usable capacity 2TB. Up to two extra 2TB NVMe disks at $83 each per month, also attached directly, not added to a hardware array.
- Bandwidth of 250 Mbps, 1 Gbps, or 2 Gbps, all unmetered, at +$0 / +$251 / +$749.
- 1 IPv4 included. Extra addresses sold one by one at $2 each per month, 0–255 extra, 256 in total on one server. Addresses are not sold as a subnet.
- One free operating system, Ubuntu 24.04 by default. Windows Server Standard is $21 a month. Datacenter is $27 a month.
- Servers are deployed in Tokyo, Japan.
Linux uses SSH. Windows uses RDP. A browser remote desktop for other desktop systems is not the main service. The console shows instances you have paid for, invoices, tickets, password changes, and power requests. It does not replace administration inside the operating system.
Accounts, guest checkout, and credentials
The order page is public. You can pay without signing in. The browser keeps a guest id so the order can be attached to the account you register or sign in with afterward. The public address, SSH or RDP, and the password are visible in the console only after you sign in.
The email address must be one you can receive. You are responsible for the password, verification codes, and server login credentials. Loss caused by leaked credentials, a shared login, or a stolen device is yours. If you see an unauthorized sign-in, change the password and open a ticket at once.
One person may hold one account. We may refuse an account that is plainly false, registered in bulk, or used to get around these terms.
Configuration, provisioning, and access
The order is the set of options submitted on the order page. Amount due = that month’s monthly total × the number of months in the term. Monthly total = model price + extra disks × 83 + bandwidth add-on + extra IPv4 × 2 + operating-system add-on. There is no setup fee and no minimum contract. The shortest term is monthly.
After payment succeeds, the paid server appears in the console. Status moves from preparing to running. Connection details appear after it is running. A delivery time in minutes is not promised, and delivery claims from other sites are not written into this page.
Power on, power off, and restart are submitted as tickets in the console. Power actions are not available until provisioning is finished. We do not reinstall the operating system or rebuild a disk array from the web page. A reinstall or a change of disk layout goes through the ticket process described in the help center.
Billing, payment, and renewal
The currency is US dollars (USD). Prices on the page exclude tax. If tax is legally yours to pay, it is shown at payment or on the invoice. It is not folded into, or hidden inside, the published monthly price.
Options are prepaid with the server for the same term. Quarterly, semiannual, and annual terms are a count of months paid in advance. They do not change the monthly unit price. The payment methods are the gateways available on the checkout page at that time. The gateway handles card or wallet credentials. This site does not store a full card number.
Before a term ends, you can read invoices in the console. If automatic renewal is open on your account, the console states how it works. If it is not open, service stops when a due payment is missed. No refund percentage and no cooling-off period are published. Until a refund rule is published separately, a paid term is not returned automatically because you changed your mind. If we cannot supply the spec you bought, and cannot replace it with an equal configuration in a reasonable time, unused time is handled in that ticket. This page does not set a fixed compensation formula in advance.
Acceptable use
You are responsible for the operating system, software, content, and outbound connections on the server. You must not use the service to:
- Break applicable law, including fraud, money laundering, distributing illegal content, or infringing intellectual property or personal information.
- Scan, break into, deny service to, or otherwise attack a third-party system without authorization.
- Send spam, run an open relay, or use the included or extra IPv4 addresses for bulk sending that damages address reputation.
- Interfere with the facility network, other tenants, or the hardware, including deliberately saturating a shared uplink or bypassing abuse handling.
- Spread a rented Windows license beyond this machine, or crack or bypass the vendor license.
If we receive a complaint, a lawful inquiry, or see clear abuse, we may limit the network, pause the instance, or require you to correct it by a stated time. In a serious case we may end the service at once and keep fees already paid. You should provide the explanation we need. Refusing to do so can be treated as a serious breach.
Disks, backups, and data
The default disks are two separate NVMe drives. There is no hardware RAID and no hardware disk protection. The second disk, and any disk you add, is not placed in an array for you. Usable capacity is the sum of the disks. 2 × 1TB is not a mirrored 1TB.
Integrity, snapshots, off-machine backups, and encryption are yours. We do not owe recovery for loss caused by a machine fault, a mistake, a software defect, or a software RAID or stripe you built, unless the loss comes directly from a hardware replacement we have confirmed in writing and you cannot restore from your own backup. Even then we do not promise that data can be retrieved. The fault process replaces or repairs hardware.
After the service ends, a term is not renewed, or the server is closed for breach, data on the disks may be erased and may not be recoverable. Move it off before the term ends.
Addresses, bandwidth, and the operating system
The default IPv4 comes with the server. Extra addresses are rented one by one. Ownership does not transfer. You may not resell an address, or announce it for something unrelated to this machine. The bandwidth rate is chosen at order time. A later increase or decrease depends on a ticket or on whatever the configuration allows then. This page does not promise a change at any moment with no interruption.
Free operating systems are the images available at the time. Windows is a right to use during the rental. Language and version follow the list on the order page. Software you install yourself needs your own license.
Maintenance, faults, and what is not promised
The following are not promises to you, and this page excludes them: a fixed provisioning time, an availability percentage (SLA), a fault-credit percentage, a first-month discount, and a 24/7 telephone line. Instructions on the help page and in the notes are not a service-level agreement.
The facility or the uplink may schedule maintenance. We will try to say so in advance through the console or a ticket. We cannot promise that every window will match a time you name. Hardware faults are handled by replacement or repair. A purchased term is not extended automatically unless a ticket says otherwise.
Suspension, ending the service, and leaving
You can end the service by not renewing. There is no cancellation penalty. Prepaid time you have not used is handled under section 5 until a refund rule is published. We may pause or end the service if payment is overdue, section 6 is seriously breached, the law requires it, your use draws ongoing complaints or a security risk, or we stop offering that model in Tokyo and have told you by ticket.
After the service ends, access details in the console may stop working, and the public address is taken back. You may ask to close the account. Historical invoices may still be kept for a period the law requires. See the privacy policy.
Limit of liability
To the extent the law allows, we are not liable for indirect loss, lost profit, lost data, or lost goodwill. Our total liability for one order does not exceed the amount you have paid us for that order. This cap does not remove liability for personal injury, or for intent or gross negligence, where the law does not allow that exclusion.
A payment gateway, an operating-system vendor, software you installed, and a separate event in facility power or an international circuit are outside what we control alone. We will help investigate within our means. We do not promise compensation for a third party’s own fault.
Intellectual property
The text, page design, marks, and documents on this site belong to us or to their owners. You receive a server rental and a right to use the site. You do not receive ownership of the site or the hardware. Content you place on the server stays with you or your licensor. You give us a limited right to process it only as needed to provide the service, clear a fault, answer a complaint, or comply with the law.
Changes to these terms
Specs, prices, and these terms may change. For an order already paid and still inside its term, the spec you bought is the configuration at payment. A later price change does not require you to pay the difference, and does not force a smaller configuration. When a change affects a material interest of yours, we will try to mark the date on this page. Paying again, or continuing to use the service, means you accept the updated text. If you do not accept it, stop renewing and move your data off.
Disputes and contact
Start a dispute with a console ticket. Until the operating entity and the court of jurisdiction are published, both sides should still try to settle in good faith. After that publication, the jurisdiction stated in the update applies. This page does not name a court in a particular country or region in advance.
Day-to-day support is a ticket. A telephone response time is not promised. Support email is support@nodekvm.com. A ticket is still the formal channel for an order or a machine. Prices and configuration notes are on the pricing page and in the help center.
